AURORA, Colo. (AP) - A judge has ruled that prosecutors can move forward with their case against a man accused of running a red light and killing a teen in Aurora in a suspected drunken-driving accident.
40-year-old Ever Olivos-Gutierrez appeared in court for a preliminary hearing Wednesday, after which the judge ruled there is ample evidence for prosecutors to pursue a first-degree murder charge.
Authorities say Olivos-Gutierrez had a blood-alcohol level at least four times the legal limit after the March 24 crash that killed 17-year-old Juan Carlos Dominguez-Palomino.
Olivos-Gutierrez is in the country illegally, and authorities say he didn't have a valid Colorado driver's license. He is scheduled to be arraigned in October.
