Court documents released to News 5 on Friday revealed new information about the arrest of Air Academy High School teacher Bryan Mertz, 40, who has been accused of having an inappropriate sexual relationship with one of his students and police say he admitted to the relationship.
According to the arrest affidavit, Colorado Springs Police were notified by a school resource officer about the alleged relationship on Wednesday. Several students had reported that they had seen the victim and Mertz at the movies together last weekend. The victim admitted to the school resource officer that she had gone to the movies with Mertz and kissed him.
Detectives with the Crimes against Children Unit took over the case and interview the student that she had been close to Mertz since September 2012 when she started to spend time with him out of class and they began communicating via text and email. She told investigators that their relationship began last October when both Mertz and the student texted each other saying that they "liked" one another. The girl also said she considered dropping Mertz's Anatomy/Physiology class because of her feelings for him.
On Nov. 20 the student said she and Mertz shared their "first passionate kiss" at Monument Valley Park and kissing became more frequent after that. In the following weeks she said they started hanging out at Mertz's home on the 500-block of Autumn Crest Circle and on Dec. 6 they said that they loved each other.
Over the past few weeks the student said Mertz started touching her inappropriately. They spent the weekend of Jan. 18 together at Mertz's home engaging in multiple "make-out" sessions, stargazing and Mertz drew a portrait of her on a sketch pad. That weekend they also went to the Tinseltown Movie Theater to see a movie where other students spotted them.
Mertz was interviewed by police on Wednesday. According to the affidavit he admitted to the relationship and described it as "boyfriend/girlfriend" and confirmed he had kissed and fondled the girl. When asked why he had engaged in the relationship Mertz said "he didn't know," that he'd acted stupidly and "liked the attention."
Mertz was arrested on Thursday and charged with Sexual Assault on a Child by one in a Position of Trust, a class-three felony. His bond was set at $25,000.
