A Fremont County judge has decided not to return three children to their parents, just days after a five-month-old died in the house.
The baby girl was rushed to St. Thomas More Hospital in Canon City last week. Child abuse was initially suspected, so the couple's other children were seized as a precaution. Capt. Allen Cooper of the Canon City Police Dept. said at the time that the couple made conflicting statements and condition of their home was not adequate.
An autopsy showed that the baby died from a medical condition, not child abuse.
Tuesday a judge ordered an attorney be appointed to represent the parents on neglect charges.
The remaining three children -- a four-year-old and two-year-old twins -- will remain in the custody of the family's aunt. The children were removed, according to the mother, due to the condition of the house, the presence of marijuana in the house and because the father had been drinking before the younger child died.
The couple will be back in court next week.
They have set up a fund for Destine in her name at Canon National Bank in Canon City.
