Denver child care workers face liability in death

DENVER (AP) - Two Denver child care workers could be held liable in the death of a 7-year-old boy who starved to death after abuse complaints went uninvestigated.
The 10th U.S. Circuit Court of Appeals Wednesday ruled the two workers are not protected by qualified immunity in the May 2007 death of Chandler Grafner. Such immunity protects government officials from lawsuits. The Denver Post reports (http://bit.ly/SUcpFn) the ruling allows the case to proceed.
Chandler had been placed in the care of his mother's ex-boyfriend, a man who was not his biological father. Chandler died after being found locked in a closet.
Chandler's family sued the workers responsible for Chandler's care.
In its ruling, a three-judge appellate panel ruled that the workers had a constitutional obligation to ensure Chandler's safety.
