Denver officer appeals penalty on text messages

DENVER (AP) - A Denver police officer who admitted using a department-issued cell phone to send sexually explicit text messages to a woman he met on-duty is appealing a 90-day unpaid suspension.

Manager of Safety Alex Martinez says officer Jay Whittenburg violated the department's rules against immoral conduct and sexual misconduct when he sent the woman a series of messages after encountering her while patrolling her neighborhood late last year.

According to the Denver Post, investigators could not determine who initiated contact because many text messages were missing and the woman's statements were inconsistent.
