GREELEY (AP)-The family of a suspected car thief authorities say shot and killed a Weld County sheriff's deputy plans to sue officers for shooting the suspect, who died from his wounds.

Denver's KMGH-TV reports that the family of 20-year-old Rueben Reyes has filed a notice of intent to sue, blaming Greeley, Evans and Weld County officers for excessive force in the Nov. 23 shooting. The family is seeking $250,000.

Investigators say Reyes grabbed Deputy Sam Brownlee's gun during a struggle and shot him three times

Officers pulled Reyes out of a car reported stolen from Fort Morgan. They say he stopped in Evans after leading them on a high-speed chase.

Reyes' family says lethal force shouldn't have been used and that Reyes lay unaided for "a significant period of time."
