Attorneys for Grand Junction are denying claims of negligence by a woman who says she was raped by a police officer last year.

The woman filed suit alleging the Police Department should have fired officer Glenn Coyne earlier, after an unrelated allegation of sexual assault was made in 2008. Prosecutors said there wasn't enough evidence to go to court in that case, and Coyne was returned to duty.

The woman says Coyne raped her in her home in September 2009.

Coyne was arrested on charges of first-degree sexual assault and first-degree burglary in that case.

He shot and killed himself after he was released on bail.

The city says Coyne's alleged actions in 2009 were outside his city duties and authority.
