Judge denies request to stay court order for seized marijuana

A district court judge has refused a request to halt his court order requiring the Colorado Springs Police Department to return marijuana that was seized from a local cancer patient.

In June, a jury found Bob Crouse not guilt of drug trafficking charges. He went to court in September to request the court order when he was denied the seized property by the CSPD on the ground that the officers would be violating federal law in distributing a controlled substance.

Crouse's attorney Clifton Black requested the emergency hearing after learning that the District Attorney's Office intends to file an appeal in the case.

Crouse and his attorney are planning to go to the police department this afternoon to pick up the 6 pounds of marijuana and 55 plants.
