Judge to rule on evidence in Perrish Cox rape case

CASTLE ROCK, Colo. (AP) - A judge may rule soon whether statements that former Broncos cornerback Perrish Cox made while in a holding cell can be used in his sexual assault trial.

A hearing is scheduled Tuesday in Castle Rock near Denver.

Cox is charged with sexual assault against a person who was physically helpless and sexual assault against a person who was incapable of determining the nature of the conduct. He pleaded not guilty and is free on $50,000 bail.

An arrest warrant affidavit says the alleged victim became pregnant and that DNA tests indicated Cox is the father.

The defense wants to bar the use of statements he made to police when he was in a holding cell after questioning by investigators.

The Broncos released him on Sept. 3, citing his on-field performance.
