77 year old Aylais Oliver has been found not guilty of the 1st or 2nd degree murder of his son Keith Oliver back on Thanksgiving of 2009. Instead, a jury Wednesday found Oliver guilty of manslaughter.
According to court documents, the father and son had been in a day long argument over chores. As the argument became heated, the elder Oliver armed himself with a gun and shot his son in the head, killing him. For prosecutors, an incident like this makes it tough to get a murder conviction. "What you have is a real limited set of facts that occurred in a really short period of time." explains prosecuting attorney Jim Bentley, "I think those are all things that probably go into a jury's deliberation as they make up their mind."
As for Marjorie Oliver, Aylais' wife, she's upset at the jury's verdict. It's an unimaginable spot to be in as her husband gunned down her son. "I just want to say I don't think justice was served." She says, "My son was killed in cold blood and my husband got charged with manslaughter."
Aylais is scheduled to be sentenced on February 4, 2011 at the El Paso Courthouse. He could face between 2-12 years in prison.
