More details are coming out on the shooting of a dog last night in the northeast part of Colorado Springs.
This afternoon the Humane Society of the Pikes Peak Region held a press conference to talk about the incident.
According to the investigators the both parties could face charges. Animal Cruelty for the man with the gun and Ownership of a Dangerous Animal for the woman who owned the dog that got shot.
" It's a matter of getting the facts of the case you know, before we make a final determination into what is going to happen," said Joe Stafford, Director of Field Services for the Humane Society of the Pikes Peak Region.
It started when both parties were out on and evening walk with their dogs in the 48-hundred block of El Camino Drive around 5pm Wednesday night.
Colorado Springs Police say that a large Mastiff broke free from his owner and a fight broke out between the two dogs.
The owner of the Greyhound shot the Mastiff point blank, killing him on the spot. Police say that the man will not face any firearms charges.
"The city code does allow for the discharge of a firearm in the city limits to protect yourself, property, or domestic animal," says Sgt Steve Noblitt with the CSPD. "In this case he was protecting his dog."
The owner of the 108-pound Mastiff named Flato says that a gun was not needed. Tammira Martinez tearfully claims that Flato isn't vicious.
She says that the Greyhound was on a retractable leash and started coming toward her. Flato leaped toward the other dog knocking her down.
She says the dogs did fight, but she said there was not need to shoot her dog.
"Two seconds to grab the leash of my dog and pull him back," Martinez cried. "But I wasn't even given that opportunity."
Martinez says the Greyhound was not seriously injured, but the Humane Society says that it did need veterinary attention and in fact had to have staples in the neck area. They also added that Flato was an un-neutered male.
We knocked on what we believe is the Greyhound owner's door this afternoon to get his response, but no one answered the door.
