Pueblo County District Attorney declines to comment on missing evidence

Pueblo County District Attorney Jeff Chostner has declined to comment about why his office could not locate evidence in the Michael Katchmar criminal investigation.

Fremont County turned the case over to the Pueblo County DA's office because of a possible conflict of interest between Katchmar and Fremont County District Attorney Tom LeDoux.

The Cañon City Police Department admitted a labeling error created some confusion in two discs provided to prosecutor Jennifer Zamarripa.

According to Police Chief Paul Schultz, the prosecutor's office requested copies of all recordings in the case be provided to them, but specifically asked that one of Katchmar's interviews be placed on a separate disc.

Instead, the recording in question was placed on the first disc and was not used at trial because the DA's office was unable to find it.

News 5 requested an interview with Zamarripa about why she was unable to catch the mistake and find the audio recording.

Chostner responded on her behalf, saying she was unavailable for an interview.

Chostner also declined to further discuss the matter with News 5.

"This is a matter before the court and may be subject to appellate review," Chostner said in an email to News 5. "It would not be appropriate to discuss at this time."
