Sheriff's Office break-in not tied to missing file

COLORADO SPRINGS - Deputies with the El Paso County Sheriff's Office arrested a homeless man last month who was breaking into their headquarters building at 27 E Vermijo Ave downtown and sleeping in the public restroom.

Daniel Mastovich, 32, was jailed on January 29 on three counts of felony trespassing and one count of criminal mischief. He was later released on $200 bond.

According to court records, he also tampered with a framed photograph of Undersheriff Paula Presley, once putting a sticky note on the picture that read I (heart) you. He admitted to investigators that he broke a second story window of a homicide detective by throwing a rock at it from the alley.

The arrest report says Mastovich slipped a magazine through the glass sliding door at the front entrance to activate the motion sensor and get inside. County maintenance workers have since disabled the inside motion sensor after hours.

Mastovich had been sleeping in the building since January 11. Officers with the Colorado Springs Police Department arrested him previously on Christmas Eve for public indecency.

The break-ins occurred at a time when deputies are investigating a missing Internal Affair archive file of sheriff's candidate Bill Elder. Nothing in the probable cause affidavit or arrest report indicates Mastovich accessed other parts of the building beyond the lobby.
