Special prosecutor file to be released in Ianne grand jury case

Pueblo District Judge Dennis Maes has ruled a special prosecutor's report related to a grand jury indictment of a Pueblo businessman can be released.

Tonny Ianne was indicted on dozens of mortgage fraud counts last year.  His attorney, Randy Jorgensen, was subsequently named as having a conflict of interest in the case.  A special prosecutor, Cynthia Kowert, was appointed from the Denver area.  When she completed her report, the Pueblo District Attorney's Office asked that it not be released because it could identify the people who had brought up Jorgensen's name in the investigation of Ianne.  No charges were filed as a result of the special prosecutor's report.

After a hearing that lasted nearly two hours, Judge Maes ruled Friday all the grand jury testimony will remain secret, but the special prosecutor's report can be released.

While grand jury proceedings are secret, the report indicated Jorgensen did know the names of several people who had testified.  Kowert's report says he did not learn those names from anyone at the District Attorney's office.
