Marijuana court order upheld

Posted 4:26 PM 11/15/2012 : Seized marijuana to be returned nearly 6 months after acquittal

COLORADO SPRINGS - Cancer patient Bob Crouse will be getting his all of his seized medical marijuana back on Friday. His attorney Clifton Black tells News 5 the Colorado Court of Appeals upheld a court order issued by a 4th Judicial District Court Judge Timothy Schutz on October 30 requiring the return of the six pounds of marijuana and 55 plants.

Black was notified by the Colorado Springs Police Department that the appellate court had denied a request from the district attorney to stop the court order. The court had granted an emergency stay of the order last week pending the review of the case. That emergency stay  expired today and the court declined a motion to extend it.

Crouse was arrested on drug trafficking charges in 2011. Then in June, a jury found him not guilty on all counts. He has an appointment to pick up the drug from the police Friday at 3:00 p.m.
